Conditions of Use for Online Contributions

Museums Victoria welcomes contributions from members of the public. While we encourage discussion and value feedback, we expect all contributors to demonstrate an appropriate level of respect for alternative points of view and for people's privacy.

You may contribute to Museums Victoria online sites and forums, subject to the following terms and conditions.

Terms and conditions

1. All material published on Museums Victoria's website is at Museums Victoria’s sole discretion.

2. Children's contributions must be supervised by an adult. The parent or guardian of the entrant must read all Terms and Conditions.

3. You may be held legally responsible for the content you submit to Museums Victoria’s website.

4. Museums Victoria reserves the right to archive and republish all contributions for promotional purposes. The submitter of content warrants that they have the permission of the relevant copyright owner to do so and that this permission allows Museums Victoria to use the entry in accordance with these terms and conditions.

5. The submitter hereby grants Museums Victoria a non-exclusive, irrevocable, perpetual, worldwide licence to use the submitted content, whether in original or modified form, in whole or in part or not at all, to use, modify, delete from, add to, publicly display and reproduce, the photo(s), including without limitation, in any online media formats and through any social media channels, pages or accounts) for the sole purpose of this aforementioned exhibition. Should Museums Victoria wish to use an entrant’s Works for any other purposes, it will contact the entrant to discuss licensing opportunities.

6. Museums Victoria reserves the right to use contributions for internal training purposes.

7. Your contribution may be edited, removed, or not published if Museums Victoria considers it to be:

  • defamatory, or otherwise unlawful or that it violates laws regarding; harassment, discrimination, privacy or contempt;
  • intentionally false or misleading;
  • an infringement of copyright or other intellectual property rights;
  • abusive or offensive, including obscenity or racial vilification;
  • compromising the privacy of yourself, other contributors or of Museums Victoria staff, or containing inappropriate personal information;
  • seeking to endorse commercial products or activities or to solicit business; or
  • deliberate provocation of other community members.

Privacy – personal information

8. When you submit personal information about yourself or any other person, you acknowledge that you have read and agree to the terms of Museums Victoria's Website Privacy Policy and consent to your personal information being handled according to that statement.

9. Museums Victoria will not disclose your personal information to other organisations without your consent, except where VicHealth and Museums Victoria is required or authorised to do so by law. 10. If your contribution contains personal information about another person who can be identified by your contribution, and they are still alive, you need to confirm that you have told or will tell them:

  • that you are disclosing their personal details to Museums Victoria;
  • that their personal information may be kept by Museums Victoria and used and published on its website;
  • how they can contact us; and
  • that they may apply to access, correct, or update their personal information,

And you confirm that they do not object to your disclosure of their personal information on this basis.

11. You should not provide any information about another person that is sensitive or is about their health unless you have their express consent to do so.

Copyright

12. Material published on the internet is protected by the same laws of copyright that apply to books, videos and music.

13. The right to "copy" always remains with the owner of the material. Unless expressly stated otherwise, you are not permitted to copy or republish anything you find on the internet without the copyright owner's permission.

14. If you wish to refer to someone else's material, we recommend you include an attribution in your message. Museums Victoria publishes links to other websites at its sole discretion. Note that under Australian copyright law, limited quotation is permissible in the context of genuine review and criticism. However, this does not permit extensive quoting of song lyrics etc.

15. When you submit content, in any format, you acknowledge that you have all necessary rights, including copyright, in the material that you are contributing to Museums Victoria’s website. You agree that Museums Victoria may use the material online and in whatever other ways Museum Victoria chooses, now and in the future.

16. The submitter acknowledges and agrees that neither the submitter nor any third party shall be entitled to any fee, royalty, or other consideration in respect of such licenced use of content. If the entrant holds, now, or at any time in the future, any so-called “droit moral” or moral rights in connection with the Works, the entrant unconditionally and irrevocably consents, for the benefit of Museums Victoria and all of its assignees, licensees and sublicensees to minor alterations to the Works which may be required for print or display purposes such as resizing and minor colour correction notwithstanding that such conduct may amount to derogatory treatment of the Works for the purposes of the Copyright Act 1968 (Cth) (Copyright Act).

Breaches of Terms & Conditions

17. Repeated breaches of these Conditions of Use may cause Museums Victoria to complain to the Internet Service Provider of the person responsible, and in very serious cases, initiate legal action.

18. Complaints or comments about the content and management of particular interactive features can be made via our general enquiries form.
